Cookie Policy

This Cookie Policy describes the types of cookies and other tracking tools used on the website www.learnamo.com (hereinafter, the “Site”), the purposes for which they are used and the ways in which the User may give, modify or withdraw their consent.

This document has been drafted pursuant to art. 122 of Legislative Decree 196/2003 (the Italian Personal Data Protection Code, as amended by Legislative Decree 101/2018), arts. 12, 13 and 14 of Regulation (EU) 2016/679 (“GDPR”) and the Guidelines on cookies and other tracking tools adopted by the Italian Data Protection Authority (Garante per la protezione dei dati personali) on 10 June 2021 (web doc. no. 9677876).

1. Scope

This Cookie Policy applies exclusively to the domain learnamo.com and its language versions (/it/, /en/, /es/).

It does not apply to:

  • third-party websites reachable through hyperlinks present on the Site, which have their own privacy notices to which reference is made;
  • LearnAmo’s official social media profiles, the processing of which is governed by the policies of the respective platform operators.

The Data Controller exercises no control over the content, the tracking technologies and the personal data practices of third-party sites and disclaims any liability in respect of the processing carried out independently by such parties.

3. What cookies and tracking tools are

Cookies are small text files that the websites visited send to the User’s device (computer, tablet, smartphone), where they are stored and then sent back to those same sites on the User’s next visit.

Alongside cookies there are other tracking tools that make it possible to identify the User or their device, to which the same rules apply. The following may be used on the Site in particular:

  • Local storage and session storage: browser memory areas used to store information on the User’s device;
  • Tracking pixels (web beacons): images or code fragments that detect the display of a page or the opening of a message;
  • Passive identifiers: technical information transmitted automatically by the device (for example IP address, browser characteristics) which, when combined, may allow the device to be identified.

Cookies are divided into first-party cookies, installed directly by the Data Controller, and third-party cookies, installed by other parties through services integrated into the Site. Based on their duration, they are divided into session cookies, deleted when the browser is closed, and persistent cookies, which remain until the indicated expiry date or until they are manually deleted.

4. Legal basis for processing

The storing of information and the gaining of access to information already stored on the User’s device are permitted, pursuant to art. 122 of the Italian Privacy Code, only:

  • without consent, where this is strictly necessary in order to provide a service explicitly requested by the User or to carry out the transmission of a communication over an electronic communications network (necessary cookies);
  • subject to the User’s freely given, specific, informed and unambiguous consent, pursuant to arts. 6(1)(a) and 7 of the GDPR, in all other cases (functional, analytics and marketing cookies).

5. Cookies and tracking tools used

5.1 Necessary cookies

They enable the basic operation of the Site, navigation between pages, authentication in the members’ area, security and the storage of the choices expressed regarding cookies. Without them the Site cannot function properly. They do not require the User’s consent and cannot be disabled through the preferences panel.

5.2 Functional cookies

They enable additional functionality and the use of content hosted on external platforms, improving the browsing experience. Disabling them may prevent certain content from being displayed. They require the User’s consent.

5.3 Analytics cookies

They make it possible to collect aggregate information on the number of visitors, the pages consulted and browsing patterns, in order to measure the performance of the Site and improve its content. Since the services used are provided by third parties that may also use the data for their own purposes and combine it with other information in their possession, such cookies cannot be treated as technical cookies and require the User’s consent.

The Site uses Google Tag Manager (Google Ireland Ltd.) as a centralised tag management system. Google Tag Manager does not itself install profiling cookies, but governs the activation of the tools listed above, which remain subject to the choices expressed by the User in the preferences panel.

5.4 Marketing and profiling cookies

As at the last update date indicated at the top of this document, the Site does not use marketing or profiling cookies. Accordingly, no tools are used to build a profile of the User’s interests, to display personalised advertising or to track the User’s browsing on third-party sites for advertising purposes.

Should such tools be introduced, this notice will be updated and the banner will be presented to the User again in order to obtain specific consent, in accordance with paragraphs 9 and 12.

6. Third-party cookies

Some of the services listed above are provided by third parties which, in relation to the data collected through their own cookies, act as independent data controllers or joint controllers, as stated in their respective privacy notices. The Data Controller of the Site has neither access to nor direct technical control over such tools or over the purposes pursued independently by the providers.

For complete information and in order to exercise their rights vis-à-vis such parties, the User is invited to consult the following privacy notices:

Given the objective complexity of identifying cookie-based technologies and the possibility that third-party providers may unilaterally modify how they operate, the list is updated with the frequency indicated in paragraph 12. Users who would like further information may contact the Data Controller at any time using the contact details indicated in paragraph 2.

7. Transfer of data to third countries

Some third-party providers are established outside the European Economic Area or carry out processing outside it, in particular in the United States of America.

Such transfers take place subject to appropriate safeguards pursuant to Chapter V of the GDPR, and specifically:

  • on the basis of the European Commission’s adequacy decision of 10 July 2023 concerning the EU–U.S. Data Privacy Framework, for providers that adhere to the Framework and appear on the official list;
  • on the basis of the Standard Contractual Clauses approved by the European Commission pursuant to art. 46(2)(c) of the GDPR, supplemented where necessary by additional measures, for the remaining providers.

The User may request a copy of the safeguards adopted by writing to the contact details indicated in paragraph 2.

8. How to give, modify or withdraw consent

8.1 Banner and preferences panel

On the first visit to the Site, a banner is displayed allowing the User to:

  • accept all cookies;
  • reject all non-necessary cookies, by means of an action just as immediate as acceptance;
  • customise their choices by selecting individual categories.

Closing the banner using the close command, without making any choice, means that only the default settings are retained, i.e. the installation of necessary cookies only. Continuing to browse, scrolling the page and clicking on elements of the Site do not in any way constitute an expression of consent.

The User may modify or withdraw the choices expressed at any time, with the same ease with which they were given, through the preferences panel, reachable on every page of the Site via the “Cookie” link in the footer. The withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent given before its withdrawal.

8.2 Browser settings

In addition to — and not as a replacement for — the preferences panel, the User may manage cookies already installed directly from their browser settings, deleting them or preventing their installation. Please note that deleting cookies from the browser also deletes the cookie storing the preferences expressed, with the result that the banner will appear again. Instructions:

8.3 Advertising network opt-out tools

The User may also make use of the platforms provided by industry associations: Your Online Choices (EU), Network Advertising Initiative and Digital Advertising Alliance (USA).

9. Duration of consent and retention of proof

The choices expressed by the User are stored for six months, after which the banner is displayed again. The banner is also displayed earlier where the conditions of the processing change significantly, for example due to the introduction of new third-party tracking tools, or where it is not technically possible to retrieve the choices previously made.

In order to demonstrate compliance with the obligations set out in art. 7(1) of the GDPR, the Data Controller keeps, through the consent management platform, a record containing the anonymous identifier assigned to the User, the categories accepted or rejected, the date and time of the expression of will and the version of the notice in force at that time. Such records are kept for as long as necessary to establish or defend a legal claim and in any case for no longer than 24 months from the withdrawal or expiry of consent.

10. User rights

In relation to personal data processed through cookies, the User may exercise at any time the rights provided for by arts. 15–22 of the GDPR, and specifically: access, rectification, erasure, restriction of processing, portability, objection, as well as the right not to be subject to a decision based solely on automated processing.

Requests may be addressed to the contact details indicated in paragraph 2. The Data Controller provides a response within one month of receipt, which may be extended by a further two months where the requests are complex or numerous, notifying the data subject accordingly.

For the processing of further categories of personal data, please refer to the Privacy Policy of the Site, of which this notice forms an integral part.

11. Minors

The Site is not directed at minors under eighteen years of age and does not knowingly collect their consent to the installation of non-necessary cookies. Should the Data Controller become aware of processing carried out without the consent of the holder of parental responsibility, it will promptly delete the data.

12. Changes to this Cookie Policy

The Data Controller reserves the right to amend this Cookie Policy at any time, including as a result of legislative changes, measures adopted by the supervisory authority or the introduction of new tools on the Site. Changes take effect from the publication date indicated at the top of the document.

Where the changes concern the purposes of the processing or the introduction of new categories of tools subject to consent, the Data Controller will highlight this by presenting the banner again. Users are invited to consult this page periodically.
